    Plaintiffs filed a response in opposition to defendant’s request, citing evidence that both the Stinson and Bryan cases should remain as the third and fourth bellwether cases, respectively—as previously ordered by the Court—and should proceed to trial.

    Seeger Weiss partner Jeffery Grand was a member of the trial team representing Antonio and Alicia Morz De Milanesi in the second bellwether trial, securing $250,000 in damages for the plaintiff and $5,000 in loss of consortium damages for his wife.

    Judge Sargus Jr. denied C.R. Bard’s motion for summary judgment, ruling that there are clear issues of fact as to whether Bard misrepresented or concealed the “substantial risks” associated with using their hernia mesh products that “could lead a jury to conclude they acted willfully or recklessly.”

    The Judicial Panel on Multidistrict Litigation ordered claims against C.R. Bard to be centralized before Judge Edmund A. Sargus Jr. in the Southern District of Ohio. Plaintiffs allege that the company’s polypropylene hernia mesh products were defective, causing serious health complications in patients.
